Hearing - Appeal of Hearing Administrator’s Decision  
P26CU00002, PADILLA - W. DIAMOND BELL RANCH ROAD  
WIRELESS COMMUNICATION TOWER (APPEAL)  
In accordance with Section 18.97.030.F of the Pima County Zoning  
Code, Ryan and Lindsay Chastain, appeal the decision of the Hearing  
Administrator in Case P26CU00002 to allow a Type 1 Conditional Use  
Permit for a new wireless communications facility located at 15949 W.  
Diamond Bell Ranch Road in the CB-1 (Local Business) zone. Section  
18.07.030.H of the Pima County Zoning Code allows wireless towers as  
a Type 1 Conditional Use in the CB-1 zone. The Hearing Administrator  
granted APPROVAL SUBJECT TO STANDARD AND SPECIAL  
CONDITIONS. (District 3)  
Motion by Chair Allen, seconded by Supervisor Cano, closed the public  
hearing, support the appeal and deny the permit, approved 4-1, Supervisor  
Heinz voted nay.

Approval of the Board of Supervisors’ Amended Meeting Schedule for  
October 2026, to add a Special Meeting on Tuesday, October 20, 2026,  
from 1:00 p.m. to 6:00 p.m., to conduct County Administrator interviews in  
Executive Session.

RESOLUTION NO. 2026 - 42, of the Board of Supervisors, adopting the  
Pima County Legislative Program for 2027.  
Substitute Motion by Supervisor Cano, seconded by Supervisor Scott, approved  
as presented including the three items submitted by Supervisor Heinz,  
Professional Certification Requirements for Elected Law Enforcement Officers,  
Strengthening Accountability for Abuse of Public Office, and Modernizing  
Accountability for County Elected Officials and to come back on 9/8/26 with any  
additional priorities that should be included, approved 4-1, Supervisor Christy  
voted nay.

Staff recommends approval of the proposed revisions to Board of  
Supervisors Policy No. C 2.7, Prohibiting Weapons in Pima County  
Facilities and Vehicles.

Non-Disclosure Agreements in Economic Development Projects) to  
reflect an expanded scope and criteria. (District 3)

Establishing a 120-day Moratorium on Data Centers in  
Unincorporated Pima County  
Discussion/Direction/Action: Directing the County Administrator to work  
with PCAO and county departments to develop a resolution declaring a  
moratorium on data centers in unincorporated Pima County until the  
County has completed its zoning code text amendment process. The  
zoning code change process was initiated by a BOS vote in September  
2025; a July 17, 2026 County Administrator memo provided a framework  
for the process to ensure Pima County zoning categories reflect the  
unique attributes of data centers. (District 3)  
Motion by Chair Allen, seconded by Supervisor Heinz. Upon roll call, approved  
3-2, Supervisors Christy and Scott voted nay.
